Jackson County shooting victim remembers thinking, ‘I can’t die like this' - MLive.com

JACKSON, MI – The last thing Austin Puhr said he remembers thinking is, “I can’t die like this.”

He woke up from a coma two weeks later in the hospital after being shot six times, he said during a preliminary examination on Friday. He’s had three surgeries, lost his spleen, had a collapsed lung and fractured ribs.

The two men accused of attempted murder are also facing charges of armed robbery in a difference incident.

Samuel Boyer, 23, of Summit Township is charged with two counts of felony firearms and one felony count each of armed robbery, discharge of a firearm from vehicle and assault with intent to murder.

Taylor Breining, 24, of Spring Arbor Township, is charged with one felony count each of armed robbery, assault with intent to murder and felony firearms.

Jackson County District Judge R. Darryl Mazur bound both cases to circuit court after a preliminary examination on Oct. 30.

They’re accused of shooting Puhr around 6:30 p.m., Sept. 6, near America’s Best Value Inn and Suites, 830 Royal Drive. They’re also accused of armed robbery around 5 a.m. that morning, as well as shooting an empty pickup.

Puhr got into a car with Breining and Boyer to sell them methamphetamine, he testified. Puhr said he had met Breining in jail and occasionally sold him meth.

Puhr was granted immunity from the Jackson County Prosecutor’s Office for any potential criminal charges for possession or distribution of controlled substances to Boyer and Breining, Assistant Prosecutor Nathan Hull said.

Boyer and Breining refused to pay him and tried to trap him in the car, Puhr said. Breining was holding Puhr’s arm when he heard a gun rack, he said.

Puhr escaped the car and was trying to get away, he testified. He was lying in grass when he saw the car turn around and come toward him. He said he remembers the sound of gunshots but did not feel them.

The last thing Puhr said he remembers is looking at the sky thinking, “I can’t die like this.” He woke up in the hospital two weeks later, he testified.

A witness who lives near the motel saw a man trying to get away from a car and running, the witness testified. He said he heard gunshots and knew the guy was shot and called 911.

Alleged armed robbery

About 12 hours before the shooting, Breining and Boyer allegedly committed an armed robbery, police said previously. The incident happened around 5 a.m. in the 400 block of Grand Street in Leoni Township.

They knocked on the door of a camper Jonathon Whiting was sleeping in, he testified on Friday. When Whiting opened the door, two men were holding guns, he said. There were also three women with the men.

For the next hour and a half to two hours, Boyer and Breining stole numerous possessions from Whiting, he testified. They left with his mechanic tools, clothes, stereos, laptops and more, he said.

The camper was parked on the property of Whiting’s parents, who have surveillance cameras that captured the robbery, he said.

Whiting called the police after watching the videos.

When police arrived on the scene after the robbery, Whiting was arrested on an unrelated gun charge. He is lodged at the Jackson County Jail.

Whiting knew Boyer and Breining before the robbery, he said. One of the women was Whiting’s ex-girlfriend. They had broken up about two weeks before the robbery, he said.

After the robbery, Boyer and Breining allegedly drove to Frank’s Shop-Rite Supermarket, 402 E. Michigan Ave., in Grass Lake, where they shot the owner’s Ford F-150.

Frank Vednerski testified that he left the store around 9:20 a.m. and saw his rear passenger window was shattered and found three bullet holes in the front passenger door.

He called the police and reviewed the store’s security footage, where he saw a hand stick out the window of a blue Chevrolet Cruze and shoot the truck, he testified.

Jackson County Sheriff Det. Sgt. Bryan Huttenlocker interviewed Breining and Boyer separately after they were arrested. Both men waived their Miranda Rights, Huttenlocker testified.

Breining told Huttenlocker that he was sitting in the passenger seat when Boyer reached over him and shot the pickup, Huttenlocker testified. Boyer also told Huttenlocker he shot the truck, Huttenlocker said.

Shortly after the pickup shooting, Michigan State Police responded to a report of shots fired that hit a home in the 10000 block of Page Avenue, which police said was probably related to the Frank’s shooting, police said previously.

Arrests

Police were watching for a blue Chevrolet Cruze before Puhr was shot, Huttenlocker said. After the shooting, he started driving around looking for the car, because he didn’t want anything to escalate, he testified.

Around 12:30 a.m., Sept. 7, Huttenlocker learned police had information about suspects, who were identified as Boyer and Breining, he said.

Police found the car and made a traffic stop in the 100 block of Hollis Street of Summit Township, Huttenlocker said. Boyer was the only person in the car, and he was driving cautiously and under the speed limit, Huttenlocker said.

A search warrant was executed at the house on Hollis Street and Boyer was arrested. Police then went to a home in the 200 block of Wisner Street in Jackson, where Breining was at, Huttenlocker said.

There were two other people in the home, whom police got out safely, Huttenlocker testified. Police tried to talk to Breining in multiple ways, but he never answered, Huttenlocker testified.

Police then got a warrant and the Jackson County Special Response Team entered the home, then arrested Breining, Huttenlocker testified.

Mazur increased bond for Breining and Boyer to $250,000 cash surety. Neither men had posted their previous bonds -- $150,000 cash surety for Breining and $100,000 cash surety for Boyer. They are lodged at the Jackson County Jail.

Boyer’s and Breining’s cases will go before Jackson County Circuit Judge John McBain. No future dates have been scheduled.
